Frank Schoneveld is a partner in the international law firm of McDermott Will & Emery, based in its Brussels office. Frank's practice includes advising on EU competition law, EU regulatory law and international trade law in the life sciences, industrial machinery, energy and chemicals sectors.
From his base in Europe Frank Schoneveld has advised for over 20 years on EU law. He brings a wealth of wider experience to the Brussels practice as he was previously European Counsel for the Australian Government based in Brussels, and later Head of the General Commercial Law Division of the UN Works Agency based in the Middle East. He has significant experience in international arbitration and litigation.
Frank has spoken and written widely on international regulatory and competition issues and international arbitration, including: Invited by the European Commission to speak to China's competition authorities (MOFCOM, NDRC, SAIC) on “EU Determination of Cartels” and “Unfair Prices as Abuse of a Dominant Position” in Guiyang, China, September 2009; invited by the ASEAN Secretariat to speak to ASEAN competition authorities on “Private Sector Views on Investigation and Enforcement of EU Competition Law” in Nha Trang, Vietnam, November 2009; “The EU Legal Representative & Good Manufacturing Practice for EU Chemical Trials”, International Clinical Trials Conference, New York 2008; “Cartel Sanctions and International Competition Policy” World Competition, Vol. 26 Nº 3; and The International Comparative Legal Guide to International Arbitration 2004: Spain (Global Legal Group, London).
Frank is an arbitrator and panelist for the UN World Intellectual Property Organisation in Geneva and for the Chartered Institute of Arbitrators in London. He is admitted to practise as a barrister in England and Australia, and as an abogado in Madrid, Spain.
Representative Experience
- Lead Counsel in numerous EU merger notifications to the European Commission and advising on cartel investigations/prosecutions of the European Commission.
- Advising the second largest Russian oil and gas producer on recovery of assets and debts through international arbitration and litigation in the United Kingdom, Russia, the Netherlands, Luxembourg, Cyprus, British Virgin Islands and Lithuania
- Advising chemical, pharmaceutical and machinery manufacturers and mining companies on EU competition law and IP law aspects of patent and trade mark licensing, cooperation agreements, aftersales and aftermarket conduct, and compliance programmes
- Advising multinational corporations on cross-border commercial law in the airport, oil & gas extraction, textile, telecoms and food processing sectors, including internet consumer sales and data protection
- Advising Scandinavian, US and Asian machinery and parts manufacturers on EU product standards, trade law and export controls
- Advising multinational pharmaceutical and medical device corporations on EU product recalls and adverse reaction notifications, EU marketing, import and manufacturing authorisations, clinical trials and investigations, GCP, GMP and GDP
- Advising machine manufacturers, life science, sound equipment and mining companies on the EU chemicals regime (REACH & Dangerous Substances), environmental rules (e.g., Greenhouse Gas Emissions, Waste Packaging, WEEE & ROHS, ozone depleting substances) and worker health and safety
- Principal advisor and negotiator for Australia in the Energy Charter and WIPO Copyright and Neighbouring Rights Treaties
- Advising multinational producers and importers of wine, beer and spirits on marketing requirements and labelling in the European Union
- Advising a Central European government on its application for membership of the European Union and implementation of WTO obligations
