Scott A. Faust is the head of the Labor and Employment Group in McDermott Will & Emery LLP’s Boston office.   Scott counsels clients in all aspects of labor and employment law.  His practice encompasses collective bargaining negotiations, arbitration, mediation and litigation of labor and employment disputes.

Collective Bargaining Negotiations and Labor Relations

Scott represents employers on a regular basis in collective bargaining negotiations, grievance arbitration, union organizing campaigns, work stoppages, labor injunction proceedings and proceedings before the National Labor Relations Board.   Scott also has extensive experience advising troubled companies and their creditors in labor intensive industries.  He has negotiated numerous collective bargaining agreements with the United Steelworkers in Massachusetts, Pennsylvania, Ohio, West Virginia, Texas, Indiana, Illinois, South Carolina, Tennessee and Colorado.  He has also negotiated agreements with the Canadian Auto Workers, SEIU, Teamsters, Machinists, Operating Engineers, Carpenters, Painters, United Plant Guard Workers, Electrical Workers, Food and Commercial Workers, Massachusetts Nurses Association and Typographers unions.

Civil Litigation and Administrative Practice

Scott represents employers in the litigation of labor and employment disputes in state and federal courts and administrative agencies, as well as in mediation and arbitration.   Cases he has handled include matters involving wrongful discharge, ERISA, employment discrimination, related employment torts, enforcement of or defending against non-competition agreements, wage and hour issues, and administrative proceedings before state and federal equal employment opportunity enforcement agencies.  He has litigated cases in state and federal courts in Massachusetts, Pennsylvania, West Virginia, Ohio, Utah, Colorado, and North Carolina, including cases on appeal to the U.S. Courts of Appeals for the First and Tenth Circuits.

Labor and Employment Advice and Counseling

Scott also provides day-to-day labor and employment counseling of clients concerning matters such as reductions in force, legal issues related to the cultural diversity of the workplace, reasonable accommodation under the Americans with Disabilities Act, employment contracts and non-competition agreements, development of employee manuals, wage-hour compliance, child labor laws and general employee relations matters.

Scott is a member of the bar of Massachusetts.   He has published articles and given recent presentations on such subjects as Trends in Private Sector Collective Bargaining, Electronic Communications in the Workplace, Physician Organizing and Preventive Techniques to Avoid Liability for Harassment in the Workplace.  He received his bachelor’s degree, with high distinction, from the University of Virginia in 1982 and his law degree, magna cum laude, from Boston College Law School in 1985.

  • Cadence Innovations, LLC – Renegotiated collective bargaining agreements in the U.S. and Canada with United Steelworkers, Teamsters and Canadian Auto Workers in connection with acquisition of bankrupt auto parts supply company.
  • WCI Steel, Inc. – Representation includes collective bargaining negotiations with the United Steelworkers and labor arbitrations.
  • Labor Counsel to Steel Dynamics, Inc., Unsecured Creditors of Dana Corp., Wheeling-Pittsburgh Steel Corp., Copperweld Co., Special Metals Co., Georgetown Steel Corp., Secured Noteholders of WCI Steel Corp., Unsecured Creditors of LTV Steel Corp., Bethlehem Steel Corp. and National Steel Corp.
  • Museum of Fine Arts, Boston – Representation includes collective bargaining negotiations with independent guard union and Area Trades Council, day-to-day labor and employment advice and civil employment litigation.
  • Robert Half International – Provide ongoing employment advice and representation in civil litigation matters throughout New England.
