David E. Rogers is a partner in the law firm of McDermott Will & Emery LLP.  As head of the Firm’s Employee Benefits, Compensation, Labor & Employment Practice Group, David’s practice is concentrated in the area of employee benefits matters, including all areas of qualified and nonqualified retirement plans, health and welfare plans and executive compensation and executive employment agreements. He served as co-partner-in-charge of the Firm’s Washington, D.C. office from 2007 through 2011.  He serves on the Firm’s management committee.

David’s area of expertise includes working with the Internal Revenue Service, the Department of Labor and the Pension Benefit Guaranty Corporation in obtaining rulings, advisory opinions and other matters.  He also represented large employers on the PBGC's 1996 Negotiated Rulemaking Committee on Reportable Events.  During 1993-1994, he served as a member of the Congressional Tax Force on the District of Columbia Retirement Board.

In the bankruptcy area, he represents Chapter 7 and 11 trustees in their role as sponsor or administrator of employee pension and welfare benefit plans, including representation before the Internal Revenue Service, the Department of Labor and the Pension Benefit Guaranty Corporation regarding issues that arise from the bankruptcy.  David was also co-counsel in Beck v. PACE in which the U.S. Supreme Court issued in 2007 a unanimous decision on behalf of a firm client regarding the fiduciary duties involved in the termination of a qualified defined benefit pension plan.

David has been repeatedly recognized among top lawyers in the field of employee benefits by The Legal 500 United States, and was named a “Leading Lawyer” in the area of ERISA in the publication’s 2011 edition.  In addition, David was named numerous times in BTI Consulting Group's Law Firm Client Service All-Star Team surveys of Fortune 1000 clients, in recognition of his superior level of client service. 

David served for numerous years as an adjunct professor at Georgetown University Law Center teaching in the area of ERISA.  He is currently on the Advisory Board to the ERISA LLM program at the John Marshalls Law School.  He was a member of the editorial advisory board for the Pension Actuary, the monthly journal published by ASPA and has been published in The Tax Lawyer.  He is a member of the American Bar Association Tax Section's Employee Benefits Committee, the District of Columbia and Florida bars as well as the U.S. Supreme Court.  He is the Vice-President of the Board of the Washington Legal Clinic for the Homeless.  He is also a fellow in the American College of Employee Benefits Counsel.
