Brian A. Benko is an associate in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Washington, D.C., office. Brian's practice includes a variety of employee benefits matters related to pension plans, 401(k) plans, cafeteria and welfare plans and executive compensation arrangements.
In the Summer of 2008, Brian worked in the Office of the Benefits Tax Counsel, U.S. Treasury Department, as the William F. Sweetnam, Jr. Scholar. While at Treasury, he assisted in drafting employee benefits and executive compensation regulations.
Brian has authored articles for publications such as the CCH Pension Plan Guide, The ERISA Outline Book and The Tax Lawyer. He is a member of the American Bar Association Tax Section and is currently the Young Lawyer Liaison for the Executive Compensation Subcommittee. Brian is also a member of the American Society of Pension Professionals and Actuaries, where he serves on the Form 5500 Schedule C Taskforce.
While in law school, Brian’s article on the Internal Revenue Code Section 409A correction program won both the American College of Employee Benefits Counsel’s Sidney M. Perlstadt Memorial Award and the Paul Faherty Tax Law Writing Competition. In addition, Brian was an extern with the Profit Sharing/401k Council of America, a teaching assistant for two courses on employee benefits and a research assistant for two employee benefits professors.
Brian is admitted to practice in Illinois and the District of Columbia.
