Rebecca Watson is an associate in the law firm of McDermott Will & Emery LLP and is based in the Firm's Washington, D.C. office.  She focuses her practice on all aspects of commercial litigation, with a particular emphasis on patent litigation.

Rebecca's experience includes a two-week jury trial in the Eastern District of Texas and practice before the Federal Circuit.  Rebecca is also experienced in all aspects of litigation, including the handling of electronically stored information and information protected by the attorney-client privilege and work-product doctrine.

During law school, Rebecca was an articles editor of The George Washington Law Review and authored "Sierra Club v. EPA: Conditional Approval of State Implementation Plans", 73 Geo. Wash. L. Rev. 851 (2005).  Rebecca also participated in George Washington Law School's Domestic Violence Project, where she worked on the Domestic Violence Legal Empowerment and Appeals Project's Supreme Court amicus brief in Davis v. Washington.  Additionally, she served as a panelist at the Town of Castle Rock v. Gonzales conference in Denver, Colorado.  Rebecca was a member of the Order of the Coif and was named a George Washington Scholar.

Rebecca is admitted to practice in the District of Columbia and Maryland and before the Federal Circuit and the U.S. District Courts for the District of Columbia, Maryland, and the Eastern District of Texas.

Representative Experience

  • Prevailed on all counts in a two-week jury trial and a separate bench trial in high-profile Blackboard v. Desire2Learn patent litigation in the Eastern District of Texas.
  • Successfully obtained a decision in favor of Honeywell International before the Federal Circuit in PureChoice, Inc. v. Honeywell International, Inc., 333 Fed. App'x 544 (Fed Cir. 2009).  The Federal Circuit affirmed the district court's determination that PureChoice's patent is invalid for indefiniteness.
