David Beckwith is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm's Orange County office.  He focuses his practice on complex litigation and trial of U.S. patent disputes, intellectual property due diligence and counseling.  David has successfully represented clients in patent matters throughout the United States, including the Eastern District of Texas, the District of Delaware and all districts in California.

David has successfully tried multimillion dollar patent cases to verdict and has appellate experience before the Supreme Court of the United States and the U.S. Court of Appeals for the Federal Circuit.  In addition to his litigation experience, he has led due diligence teams in preparing complex opinions regarding patent infringement and validity issues, and advised clients concerning licensing matters and IP portfolio due diligence associated with mergers and acquisitions.

David has broad technical experience in diverse technologies such as peptide chemistry, bioinformatics, DNA probe hybridization, hard disk drives, CD players, plasma TV displays, sputtering targets, hemodialysis devices, infusion pump technology, virtual private networks (VPNs), data compression and internet security.

David received his J.D. from the University of Virginia School of Law and his B.S. in organic chemistry from Purdue University.  He holds an Amateur Extra Class Radio operator’s license from the FCC.

David is a member of the bars of the Supreme Court of the United States and the state of California.  He is admitted to practice in all district courts in California and before the U.S. Court of Appeals for the Federal Circuit and the Ninth Circuit Court of Appeals.

  • Representation of multiple defendants in patent infringement case involving wide area network optimization and data compression, which successfully settled at commencement of trial 
  • Representation of plaintiff in patent infringement case involving internet security, resulting in $200 million settlement 
  • Representation of plaintiff in patent infringement case involving infusion pump technology, which successfully settled immediately before trial
  • Representation of plaintiff in patent infringement case involving cancer treatment, resulting in multimillion dollar jury verdict
  • Representation of defendant in patent infringement case involving hemodialysis machines with a summary judgement of no infringement upheld on appeal
  • Representation of plaintiff in patent infringement case involving plasma TV technology, which successfully settled before trial
  • Representation of plaintiff in patent infringement case involving sputtering targets for hard drive manufacture, which successfully settled before trial
  • Representation of defendant in an inventorship dispute involving bioinformatics technology
  • Representation of plaintiff in a patent ownership dispute involving seed genetics
