Michael G. Austin is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Miami office. He focuses his practice on complex commercial litigation and intellectual property litigation. He has experience in diverse areas of litigation, including corporate, securities, intellectual property (trademark, unfair competition, trade secrets and copyright), civil rights, civil RICO, health care, government contracts, entertainment industry, and probate and trust litigation.
Michael has extensive experience in litigation involving the enforcement of restrictive covenants, such as non-competition, non-solicitation and confidentiality provisions, and complex litigation involving misappropriation of trade secrets and unfair competition. He also has vast experience in connection with class action defense (both nationwide and statewide class actions), including class action lawsuits involving consumer fraud claims, product liability claims, securities claims and a variety of health care industry disputes.
Michael represents clients in complex health care litigation and regulatory enforcement actions, including regulatory investigations and enforcement actions by Florida’s Agency for Health Care Administration and other state and federal regulatory agencies.
Michael also has experience in financial services litigation, including representation of national and international financial and investment institutions, in connection with complex and cross-border litigation. He has represented the Federal Deposit Insurance Corporation, as a receiver, in connection with litigation and claims relating to alleged improper lending practices.
Michael has represented clients in connection with a variety of labor and employment disputes, including defending against discrimination claims and counseling in connection with employment issues and retaliatory discharge claims.
Michael previously served as a legal intern in the appellate division of the United States Attorney’s Office, Southern District of Florida, where his appellate advocacy duties included drafting appellate briefs (in cases ranging from white-collar crimes to drug trafficking offenses) for submission to the United States Court of Appeals for the Eleventh Circuit.
During law school, Michael graduated first in his class and he was Articles and Comments Editor for the University of Miami Law Review.
Michael is a member of the Florida Bar, and he is admitted to practice before the United States District Courts for the Southern and Middle Districts of Florida.
