Thomas O. Bean is a partner in the law firm of McDermott Will & Emery LLP based in the Firm’s Boston office.  He is a member of the Firm’s Trial Department, where he focuses his practice on bankruptcy and commercial litigation.

Prior to joining McDermott, Tom spent over fourteen years in private practice.  He also served as a Massachusetts assistant attorney general in the Government Bureau for over five years.  In this position, he argued more than 15 cases before the U.S. Court of Appeals for the First Circuit and the Massachusetts Supreme Court.  He also tried numerous cases in the Massachusetts Superior Court and the U.S. Bankruptcy Court.

Tom co-chaired the Bankruptcy Section of the Boston Bar Association from 2002 to 2004.  He is a member of the American Bankruptcy Institute and a frequent lecturer on bankruptcy topics.

Representative experience

  • Representation of a Fortune 50 company in defending a trustee’s $20 million claim for breach of fiduciary duty and receipt of preferential and fraudulent transfers
  • Representation of an equipment lessee in a $14 million action against an equipment lessor for fraudulent misrepresentation and unfair trade practices
  • Representation of purchasers of goods from a financially distressed manufacturer
  • Representation of a financial institutions and leasing companies in the recovery of distressed loans and leases in workout, litigation and bankruptcy
  • Representation of buyers of assets of bankruptcy cases
