Jay E. Rivlin is a partner in the law firm of McDermott Will & Emery LLP based in the Firm’s New York office.   He is a member of the Private Client Department, where he advises clients on trust and estate matters, as well as a broad range of estate planning issues. 

Mr. Rivlin joined McDermott from the private client group of an international law firm based in New York.   He has extensive experience in complex estate planning matters, trust and estate administration, dispute resolution in connection with wealthy families, the administration of major private foundations, the formation and administration of closely held businesses, the acquisition and sale of private aircraft, and tax and FAA issues relating to the ownership of aircraft.

Mr. Rivlin was an articles editor for the Hofstra Law Review, in which he had his note, "Recognizing an Independent Tort Action Will Spoil a Spoliator's Splendor," published in 1998.

Mr. Rivlin is a member of the American Bar Association. 

 

Representative Experience

  • Continuously craft simple and complex (as desired and as appropriate) estate plans for individuals and families with wealth from $5 million to multiple billion dollars
  • Implemented numerous estate planning initiatives for well-known investment banking institution with exceptional success (passing in a single initiative over $260 million to future generations free of most estate and gift taxes)
  • Negotiated many valuation issues with the IRS, including art valuations, blockage discounts, lack of marketability, lack of control and minority interest discounts
  • Administered many estates ranging in total value from $8 million to $1.3 billion, with some estates involving many asset classes and assets in multiple jurisdictions 
  • Counseled prominent New York City real estate family in settlement of patriarch's disputed estate
  • Participated in mediation and settlement of intra-family and intra-company disputed loans aggregating more than $300 million   
  • Structured numerous tax efficient and FAA compliant transactions involving the purchase, sale and lease of 100% interests in private jets and helicopters
  • Represented countless clients in connection with fractional ownership of private aircraft in all of the popular (and some of the not so popular) fractional programs available today  
  • Participated in well-publicized settlement of multi-billion dollar family trust litigation
