Stefan M. Meisner is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Washington, D.C., office. Stefan is a member of the Firm’s Antitrust & Competition group. Stefan also is co-chair of the Firm’s Electronic Data Management, Privacy & Discovery group.
Antitrust
Stefan’s antitrust practice focuses on complex, multidistrict class action litigation alleging Sherman Act violations; merger investigations; and intellectual property issues. He has substantial experience in a variety of industries; namely, consumer products, defense and aerospace, high tech, building materials, hospitals, alcohol beverages, steel, mining and aggregates.
Stefan has handled ground-breaking antitrust litigation involving the scope of intellectual property rights and the misuse doctrine. Stefan regularly counsels clients on the antitrust implications of patent licensing and settlements of infringement litigation.
Stefan’s practice extends to counseling clients on global strategies for addressing cartel prosecutions and defenses, from the inception of government investigations, to the initiation of civil class action litigation, in a variety of jurisdictions.
Stefan also counsels clients on merger notification under the Hart-Scott-Rodino Act and multinational notification regimes. Stefan has counseled clients on major mergers and acquisitions including significant acquisitions in the aggregates, defense and aerospace, beverage, consumer products, high tech, medical equipment and steel industries.

- In re Chocolate Confectionary Antitrust Litigation—defending Mars, Incorporated in class action price fixing litigation
- Static Control Components, Inc. v. Lexmark Int’l, Inc.—successfully defended copyright, DMCA, and patent infringement action, including assertion of patent misuse defense, obtaining favorable jury verdict after five-week trial
- Medtronic MiniMed v. Smiths Medical—obtained dismissal of patent infringement suit
- Jung v. Association of Am. Med. Colleges—obtained dismissal of class action “wage fixing” litigation
Transactions:
- Obtained clearances for numerous transaction involving distributors of home building supplies
- Obtained clearances for numerous transactions involving aggregates suppliers
- Diageo’s acquisition of Seagrams, creating the largest beverage alcohol supplier
Successfully defended numerous transactions in the aerospace and defense industry.
E-Discovery and Litigation Readiness
Stefan regularly counsels clients on electronic discovery issues in both the litigation and regulatory arenas, developing efficient and effective solutions for businesses facing issues with e-discovery and management of electronically stored information. Stefan has counseled clients on developing effective strategies for managing electronic records in light of evolving standards on preservation and production of electronic documents and data under the U.S. Federal Rules of Civil Procedure. Stefan is a member of The Sedona Conference’s® Working Group on Electronic Document Retention and Production, as well as an active participant in the Electronic Discovery Reference Model’s standards setting project for providers of software and services related to electronic discovery.
Stefan serves on the Firm’s pro bono and recruitment committees. Stefan is active in representing U.S. service veterans who are seeking government benefits related to their service.
While in law school, Stefan served as the Editor-in-Chief of the American University International Law Review.
Stefan is admitted to practice before the U.S. Supreme Court, the U.S. Courts of Appeals for the Third, Sixth and Seventh Circuits, the U.S. Court of Appeals for the Federal Circuit and the U.S. Court of Veteran’s Claims, as well as many U.S. District Courts throughout the United States.
