Edward P. Leibensperger is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Boston office. He focuses his practice on the litigation and trial of general business, securities, corporate governance, and professional liability cases.
Ned has been a Fellow of the American College of Trial Lawyers since 1995. He has been listed in The Best Lawyers in America for many years and has been selected for its elite listing as a “Bet the Company” litigator. He also is ranked in the first category of leading lawyers in the 2006, 2007, 2008 and 2009 editions of Chambers USA for commercial litigation. Chambers USA cites Ned as having “the perfect combination of knowledge, skill and demeanor.”
Ned’s experience includes trials of numerous jury cases in both state and federal courts. He also appears regularly in courts on preliminary injunctions, motions and jury-waived hearings. He has handled appeals in the U.S. Court of Appeals for the First and Second Circuits and the Massachusetts Supreme Judicial Court and Appeals Court. He is admitted to practice before the Supreme Court of the United States.
Among Ned’s clients are Big Four accounting firms, law firms, Fortune 100 corporations and numerous small businesses and individuals. Recent completed trials include the defense of the general partner of a billion dollar limited partnership in an acquisition dispute, defense of a general contractor with respect to a multi-million dollar construction claim, defense of a Big Four accounting firm in a malpractice suit and representation of a minority shareholder claiming fraud in connection with a pre-IPO buyout by the majority shareholders. Ned has also represented defendants in private securities litigation as well as before the Securities and Exchange Commission. He also has represented plaintiffs in business cases, obtaining settlements and verdicts in the multi-million dollar range.
In 1991, Ned was appointed Special Assistant Attorney General to work with the Massachusetts Attorney General’s Office in a lawsuit challenging the methodology of the U.S. census. He has also received appointments as a member of the federal Criminal Justice Act panel to defend indigent criminal defendants. Recently, Ned was asked to conduct the defense, in the role of John Adams, in a mock trial at Faneuil Hall of the famous Boston Massacre case.
Ned recently served as President of the Boston Bar Association and has previously served as chair of the BBA’s Litigation Section and Professional Liability Committee. Ned also served as a member of the Governing Council of the American Bar Association’s Section of Litigation and was the co-chair of the Committee on Corporate Counsel.
While in law school, Ned was a member of the Order of the Coif and served as an editor of The Ohio State Law Journal. He also holds a certified public accounting license from the State of Ohio.
