David A. Gay is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm's San Diego office. He focuses his practice on pharmaceutical and biotechnology intellectual property law.
David advises established as well as emerging pharmaceutical and biotechnology companies as to the strategic design, acquisition and management of intellectual property portfolios, with particular attention to the integration of business objectives and competitive technologies. David’s expertise includes evaluating patent portfolios and conducting due diligence for venture capital, private and public financing, as well as for mergers and acquisitions in the pharmaceutical and biotechnology areas.
David’s experience encompasses patent portfolio management, U.S. and foreign patent prosecution, opposition proceedings, due diligence reviews, freedom to operate investigations, validity and infringement analyses, and technology licensing. Having practiced in the life sciences arena for nearly sixteen years, David brings to bear a broad-based expertise and frequently counsels clients addressing sophisticated issues arising from the merger of different and complex technologies. In the area of strategic planning, David advises corporations on the management of portfolios in areas including protein and small molecule therapeutics, humanized antibodies, immunomodulatory agents, pharmaceutical formulations, genomics, proteomics, bioinformatics and biosensors as well as in diverse areas of biochemistry, genetics and molecular biology.
David received his Ph.D. in biochemistry from Johns Hopkins University School of Medicine and earned his J.D. from the University of San Diego School of Law. He is a member of the State Bar of California and the District of Columbia and is admitted to practice before the U.S. District Court for the Southern District of California. David is a registered patent attorney admitted to practice before the U.S. Patent and Trademark Office.
David has been named among the San Diego County Top Attorneys 2008 by The Daily Transcript. The Top Attorneys 2008 were selected by peers as among the best in San Diego County’s legal community. David has co-chaired the Special Committee on Biosciences and Chemical Practice for the ABA Section on Intellectual Property Law for the past two years. Previously, David served as the co-chair for the Licensing Committee and as the chair of the Patent Licensing Subcommittee for the same ABA Section.
