Lincoln Mayer is an associate in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Washington, D.C. office.  Lincoln’s practice focuses on antitrust and competition, with particular experience counseling clients on antitrust liability, defending mergers and transactions, and appellate litigation.

Lincoln’s antitrust counseling includes advising a major defense contractor on the antitrust impact of acquisitions and teaming agreements; advising a national health care company on refusals to deal; advising a hospital system on application of the state action doctrine to mergers and affiliations; advising investment firms on litigation-related antitrust arbitrage; and drafting antitrust guidelines for an agricultural company. Lincoln’s experience defending mergers and transactions before the FTC includes deals in the agriculture, energy, food processing, health care, and media sectors.  He also worked on a government investigation related to exclusive dealing, and has engaged in motion practice and discovery for complex litigation on matters involving price discrimination, price-fixing, monopolization, and antitrust standing. 

Lincoln’s appellate experience includes drafting briefs in the successful defense of an antitrust tying claim on appeal to the U.S. Court of Appeals for the Third Circuit; the appeal of a judgment on antitrust standing to the U.S. Court of Appeals for the Sixth Circuit (decision pending); and the appeal of a denial of veterans benefits to the U.S. Court of Appeals for Veterans Claims, achieving a favorable settlement after submitting the opening brief.  Prior to joining the Firm, Lincoln served as a law clerk to the Honorable Alex Kozinski, Chief Judge of the U.S. Court of Appeals for the Ninth Circuit. 

Lincoln earned his J.D. from Stanford Law School, where he was elected to the Order of the Coif and served as President of the Stanford Law Review.  While in law school, he authored Immunity for Immunizations: Tort Liability, Biodefense, and Bioshield II, 59 Stan. L. Rev. 1753 (2007).

Lincoln earned his B.A. from Amherst College, summa cum laude, and was elected to Phi Beta Kappa in his junior year.  He received the Havighurst Prize for Outstanding Scholarship in history and the Gilbert Prize for oration, and served as the Phi Beta Kappa induction speaker. After graduation, Lincoln taught history of Western civilization at Sidwell Friends School.

Lincoln is admitted to practice in the Commonwealth of Virginia and the District of Columbia. He is also a member of the ABA Section of Antitrust Law, its Transportation and Energy Committee, and its Agriculture and Food Committee.
