OSHA, MSHA & Catastrophe Response
McDermott Will & Emery’s OSHA, MSHA & Catastrophe Response Group is recognized as one of the leading practices of its kind in the United States. The group includes former top officials from the Occupational Safety and Health Review Commission and the Federal Mine Safety and Health Review Commission.
The group has more than 25 years of experience managing complex multi-agency investigations following major industrial catastrophes in the petroleum refining, chemical, construction, manufacturing and mining industries. Lawyers in the group have substantial hands-on experience with every agency that traditionally responds to industrial catastrophes, including the Occupational Safety and Health Administration (OSHA); U.S. Chemical Safety & Hazard Investigation Board (CSB); Environmental Protection Agency (EPA); U.S. Department of Homeland Security (DHS); National Transportation Safety Board (NTSB); U.S. Coast Guard (USCG); Mine Safety and Health Administration (MSHA); Bureau of Alcohol, Tobacco and Firearms (ATF); and other federal, state and local agencies involved in emergency response and investigation activities.
The group pioneered petrochemical Process Safety cases, from the very first large-scale chemical plant inspection by OSHA in 1985, to the first major refinery incident investigation by the CSB in 2001, to the most significant chemical and petrochemical cases of today. The OSHA, MSHA & Catastrophe Response Group regularly represents clients before the Occupational Safety and Health Review Commission, the Federal Mine Safety and Health Commission, the U.S. Chemical Safety and Hazard Investigation Board, federal appellate courts, U.S. Department of Labor panels and officials, the National Institute for Occupational Safety and Health (NIOSH), and state agencies and courts.
