With offices in the United States, London, France and Germany, and a strategic alliance with MWE Law Offices in Shanghai, the broad geographic dispersion of McDermott Will & Emery’s labor & employment practice enables us to serve clients on international, national, regional and local levels. Our Firm represents employers in virtually every industry, including manufacturing, financial services, health care, education and construction.
Our goal is to help clients maximize their human resources, while avoiding exposure to liability. Employment disputes, however, often result in litigation despite following best practices. Our lawyers conduct a full range of labor and employment litigation before U.S. federal and state trial and appellate courts, and U.S. administrative agencies as well as the European and Asian equivalents. We also arbitrate and mediate all types of employment disputes and, in the United States, represent employers in collective bargaining negotiations, grievance arbitration, maintaining a union-free environment and election and unfair labor practice proceedings before the National Labor Relations Board.
In the United States, Europe and Asia we counsel clients concerning matters such as privacy and data protection, reductions in force, executive employment and severance, cultural diversity of the workforce, early retirement programs, employment contracts and non-competition agreements, trade secret protections, reorganizations and outsourcing, development of employee manuals, wage-hour compliance, substance abuse programs and drug testing, as well as general employee relations matters. We also work closely with lawyers in our employee benefits practice to insure full compliance with the laws and to defend benefits litigation.
In Europe, we have extensive experience advising on European labor law, European Works Councils, the German Act against Unfair Dismissal and the German Shop Constitution Act. Our UK, French and German offices also coordinate Pan-European employment and labor assignments. In addition, we counsel clients regarding labor and employment issues involving global, regional and local corporate mergers, acquisitions and restructurings.
