Monte Dube was quoted in the June 29 issue of Modern Healthcare regarding Richard Scrushy, former HealthSouth Corporation CEO, being sentenced for over seven years and ordered to pay $50,000 in fines for paying former Alabama Gov. Don Siegelman to obtain a seat on the state certificate-of-need board for a HealthSouth representative.  “In some states, CON has long had a reputation for being a political/regulatory cesspool.  The message generally is when you jump in, you better play by the rules or be prepared to pay the price,” Mr. Dube said.

Monte Dube was quoted in the October 23 issue of Modern Healthcare in an article about various healthcare deals being terminated in less than a month.  This reflected greater scrutiny on the part of potential buyers looking to avoid unexpected problems down the road, according to industry experts.  "At least today, buyers are always going to factor in the upside of a return on investment, but increasingly they are factoring the downside – such as false claims disclosure and staff dissension," said Mr. Dube.

Monte Dube was quoted in the October 23 issue of Modern Healthcare in an article about public hospital systems in Florida and North Carolina that have purchased five hospitals in an effort to adapt to market pressure and health care's capital-heavy demands.  "It's atypical and I think they are market-specific.  It's getting bigger instead of changing your stripes," Mr. Dube said.  Mr. Dube was quoted saying that while public hospitals face significant competitive challenges thanks to their ownership, potential immunity from federal antitrust rules is among the perks.

Monte Dube was mentioned in the November 10 issue of the Clarksville, Tenn., The Leaf-Chronicle in the article "Hospital Deal Hinges on Conflicting Values," regarding a conflict between the Memorial General Hospital District Board of Trustees and Gateway Health System over the proposed deal to build a new hospital in Clarksville, Tenn. "Gateway Health System officials, including Gateway's attorney Mr. Dube, continued to call such a sale a 'mischaracterization' of the transaction, noting that a nearly $200 million investment in a new hospital would instantly make the facility the community's largest taxpayer."

Monte Dube was quoted in the November 3 issue of the Clarksville, Tennessee, The Leaf-Chronicle in the article "District Seeking $60 million for Hospital" regarding a new proposal for Gateway Health System and Triad Hospitals Inc. that would result in an outright sale of Gateway's Memorial General Hospital to the joint venture seeking to build a new hospital.  The deal, if approved, would ultimately result in a new, $200 million hospital.  Regarding the proposed hospital sale, Mr. Dube contended the Memorial General Hospital District is oversimplifying the revenue benefit to the city and county from the current deal proposal.

Monte Dube was quoted in the August issue of Chicago Lawyer in the article "2005 Practice Group Survey: Health care law sees only growth as industry expands." Mr. Dube said, "To be a general business lawyer, while important, won't help you understand an industry that is very arcane and has very special rules for how you do business, how you make deals, and how and whether you'll be paid."

Monte Dube was quoted in a Special Report in the January 3 issue of Modern Healthcare regarding new challenges facing executives at hospitals, health systems and other provider organizations this year.  Monte stated that hospital boards and administrators will be under even greater pressure to meet or surpass standards for transparency and accountability in the wake of Enron, the Sarbanes-Oxley Act and the ongoing scandals of Wall Street.  "The public expectation for not-for-profit hospitals is that their standards and practices of corporate responsibility and governance should exceed what the law requires."  Mr. Dube also mentioned that the IRS will continue to analyze how hospitals compensate executives and whether board members profit unfairly.  "The not-for-profit hospital is no longer an island.  Those who don't believe how serious the government is are hiding their heads in the sand," he added.

Monte Dube was quoted in American Lawyer's Focus Europe, Winter 2004 edition.  The article addressed privatization in Italy.  Mr. Dube discussed privatization in the health care industry, "There's pent-up venture capital money to be spent in the health care industry.  In Italy, I think we're going to see the agile, smaller players come in when the opportunity is right. . . . I think the government is going to look at testing . . . the water."

Monte Dube was quoted in the March 24 issue of Modern Healthcare in an article reporting that not-for-profits are voluntarily adopting new corporate accountability and board oversight mandates.  "You can't have the corporate responsibility issues arise and laws arise without it being exported expectationwise to the not-for-profit world," commented Mr. Dube.

Monte Dube contributed a Letter to the Editor in the November issue of the Harvard Business Review.  Mr. Dube discussed the illusory benefits of "…establishing elegant board and committee structures, as well as implementing policies and procedures that embody governance best practices and mechanisms to reduce legal risks."
