Jay T. Taylor was quoted in an October 22 article published by Food Chemical News regarding the advantages and disadvantages of the food safety and quality standards that have been imposed on suppliers by multinational processors and retailers. As a speaker at the World Food Day symposium in Washington, D.C., Mr. Taylor questioned how private standards should be addressed under the World Trade Organization (WTO). "Government needs private standards and controls, but how do they interact with the WTO? When is a private standard truly private? If it's incorporated into a government standard, it would be subject to SPS disciplines. Are governments required to make sure that private standards comport with international norms? Most lawyers say no," Mr. Taylor said.

Robert Nicholas was quoted in the Boston Globe on March 2 regarding the FDA asking Congress to give it more powers to dictate the warnings on drug labels. The FDA has strong authority to dictate labeling language before a drug is approved. "Once a product is on the market, it's like a property right," commented Bob. The FDA still has negotiating clout because if a drug company refuses its suggestions the agency could initiate legal proceedings to remove the drug from the market or it could ask the secretary of the DHHS to declare a drug an imminent hazard. "There are lots of informal rules -- there is jawboning and discussions," Mr. Nicholas said.

The December 23, 2002 issue of Forbes quoted Marc Sorini in an article on efforts by the U.S. Bureau of Alcohol, Tobacco and Firearms to change the regulations of flavored malt beverages. Mr. Sorini was quoted as counsel to Diageo, maker of the leading flavored malt beverage, Smirnoff Ice.
