McDermott Secures Major ITC Patent Victory For Qualcomm
WASHINGTON, D.C. (December 3, 2008) — McDermott Will & Emery lawyers obtained a major victory in the International Trade Commission (ITC) for Qualcomm Incorporated (QCOM), a leading developer and innovator of advanced wireless technologies and data solutions. An ITC Administrative Law Judge ruled that Qualcomm did not infringe on two patents owned by Tessera, Inc. and found that the patents are valid.
"This was an outstanding victory for Qualcomm in a very complex, significant case," said Dave Dolkas, one of McDermott's lead attorneys. "Our litigation team put forth an outstanding effort and we are delighted with the result we obtained on behalf of Qualcomm."
Tessera petitioned the ITC in May 2007 for an investigation of Qualcomm and five other Respondents arising from alleged infringement of two patents relating to semiconductor packages. Each Respondent was represented by different law firms, and the defense of the case required unprecedented coordination between the parties and their lawyers.
For McDermott the ITC hearing team was led by Dave Dolkas with support from Dan Foster and Terry Ahearn. The non-infringement team was led by David Larson with support from Peter Siavelis, David Kays, Hong Lin and David Chase. Matt Gryzlo led the McDermott invalidity team with support by Brett Bachtell.
