McDermott's Role in the Pepsi/Quaker Merger

WASHINGTON, DC — Lawyers from McDermott Will & Emery's Washington, D.C. office acted as antitrust counsel for The Monarch Beverage Company, Inc., in connection with Pepsi Co.’s buyout of Quaker Oats Co. PepsiCo agreed to sell its All Sport isotonic beverage to Monarch to facilitate the Federal Trade Commission’s (FTC) review of its acquisition of the Quaker Oats Co. McDermott lawyers, Ray Jacobsen, head of the firm’s antitrust practice, and Joel Grosberg, associate, have been advising Monarch in its negotiations with PepsiCo and more recently before the FTC. When the FTC voted to end its investigation of PepsiCo's $13.8 billion acquisition of Quaker and allow the buyout to proceed, PepsiCo and Monarch closed the All Sport transaction.
