Judge Denies Injunction Against Infineon
SILICON VALLEY (November 23, 2009) — McDermott Will & Emery LLP, announced that Judge Joseph C. Spero of the U.S. District Court for Northern District of California reversed a preliminary decision to grant Volterra’s motion for a preliminary injunction against Infineon Technologies AG, Infineon Technologies North America Corp. and Primarion Inc. (Infineon/Primarion) in the Volterra Semiconductor Corp. v. Primarion Inc. et al., patent infringement lawsuit.

Volterra sued Infineon in November 2008, claiming Infineon and its wholly owned subsidiaries, Infineon Technologies North America Corp. and Primarion Inc., infringed five patents describing "flip chip" integrated power products used in voltage regulator applications. Two of the patents were stayed because of pending reexamination proceedings before the USPTO. Volterra initially moved for a preliminary injunction on two of the remaining three patents. In late September, Judge Spero indicated that he would grant the motion for a preliminary injunction. However, after further briefing, argument and consideration, Judge Spero issued a formal order on November 17 denying the motion for a preliminary injunction.
