Disability Benefits Awarded to Mother of Two
WASHINGTON, D.C. (September 13, 2004) — McDermott Will & Emery successfully appealed the Social Security Administration’s denial of disability benefits and supplemental income to a pro bono client, an individual suffering from depression and diabetes-related ailments. The client, a 40-year old mother of two who, out of necessity after being forced into unemployment due to her illnesses, moved herself and her family into a local shelter.
On two previous occasions, the Administration refused to award benefits. However, McDermott's pro bono legal team, all of the Firm's Washington, D.C. office, successfully argued that our client’s conditions were disabling not only from the date she originally filed for benefits, but five months prior to her original filing. This success permitted the client to recover two and one-half years of past denied benefits. Moreover, the Administration granted continuing disability and supplemental income benefits. This decision now provides the client with the means to care for her own needs, and to better care for the needs of her children.
