IP Team Obtains Significant Victory for Medtronic

WASHINGTON, DC - The international law firm of McDermott Will & Emery is pleased to announce the recent success of their team in the Firm's representation of Medtronic, the world’s leading medical technology company which provides lifelong solutions for people with chronic diseases. On Friday, April 6, 2001, Judge Shabaz of the Western District of Wisconsin granted Medtronic's motion for summary judgment, dismissing with prejudice all of the plaintiff's patent infringement claims against Medtronic.

The case, which was filed this past fall in the "rocket docket" of Madison, Wisconsin on behalf of a Dr. Jeffrey Kreamer, alleged infringement of Dr. Kreamer's stent graft patent and was seeking that damages be trebled. Following a compact and intense discovery period and prior to a trial scheduled for May, Judge Shabaz made a favorable decision for Medtronic, citing various arguments and positions presented by the Firm's legal team in the motion papers.

The litigation team for Medtronic was comprised of members of the Firm's IP Department including Ray Lupo, Steve Shahida, Natalia Blinkova, Judy Vesely, Debbie Johnson, Aleice Goodwin, Marcella Stafford, and Angela Newsome, from the Firm's Washington, D.C. office; and Terry McMahon from the Silicon Valley office.
