Three Favorable Decisions Secured for Victoria's Secret Under Domain Name Dispute Policy
WASHINGTON, DC — Attorneys in the Washington, D.C. office of McDermott Will & Emery recently won three domain name disputes concerning domain names that are confusingly similar to the famous trademark and service mark VICTORIA'S SECRET.
The Complaints were filed with the National Arbitration Forum pursuant to the Internet Corporation for Assigned Names and Numbers ("ICANN") Uniform Domain Name Dispute Resolution Policy ("Policy"). This policy provides for resolution of domain name disputes in a neutral forum that is quicker and less expensive than court litigation. All accredited domain name registrars who register and assign .com, .net, or .org domain names are required to adopt and apply the Policy.
In these decisions, the presiding panelists determined that the domain names victoriassecrets.net, victoriasecret.com, and victoriassecret.org were confusingly similar to the famous mark VICTORIA'S SECRET, that the respective registrants had no legitimate rights or interests in the domain names, and that the names were registered in bad faith under the ICANN Policy. Accordingly, the panelists ordered that the domain names be transferred to Victoria's Secret.
