Antitrust Litigation

Representing both plaintiffs and defendants, the Antitrust & Competition Group has substantial experience in most major industrial sectors and has litigated precedent-setting cases in the last 10 years.  Recent representations include some of the largest antitrust class action cases, including recently filed U.S.-wide class actions alleging antitrust conspiracies among producers of steel and of chocolate candy, and the long-running DRAM and SRAM cases.  We also have significant experience defending civil (link) and criminal-cartel antitrust (link) allegations.

Our experience includes consumer class actions, competitor suits and government investigations, many of which are multidistrict litigations that involve international jurisdictions and concurrent criminal inquiries.

We help our clients resolve antitrust issues in cases involving claims of bundling, price fixing, monopolization, tying, restraint of trade, dealer terminations, antitrust counterclaims in patent and trademark litigation, predatory pricing, and litigated challenges to mergers and acquisitions.

We also counsel clients on prosecuting antitrust claims against competitors when no other solution could achieve the same results.

McDermott has more than 80 antitrust and competition lawyers, and one of the largest numbers of former Federal Trade Commission, U.S. Department of Justice and European Commission lawyers.
