Tax - e-Business
McDermott Will & Emery's tax practice is one of the world's largest and most comprehensive. Our tax lawyers are on the cutting edge of e-business issues, dealing, for example, with questions of nexus. The answers to such questions determine whether a remote seller is required to collect and/or is subject to U.S. state and local taxes. Our lawyers also focus on issues regarding the source of transactions and income reporting. We advise internet service companies and companies doing business on the internet on structuring their operations to minimize U.S. federal, state and local taxes as well as non-U.S. taxes, including value added taxes.
We were extremely active in the earliest days of e-business, seeking to shape future law through our work on the National Tax Association's Electronic Commerce Tax Project's Steering Committee and dedicated participation in the activities of the Federal Advisory Commission on Electronic Commerce. Our current representation of a coalition of major corporations is in an effort to ensure that the U.S. Congress considers certain important aspects of tax policy when it determines how e-business transactions and businesses should be taxed and our participation in multistate streamlined sales tax effort serves as a continuation of that earlier activity.
