Health Care Law Reform
The historic passage of the Patient Protection and Affordable Care Act (“Affordable Care Act”), which expands access to health insurance for tens of millions of Americans and overhauls our health system, affects every major sector of the health industry. With the nation’s most comprehensive health law practice, McDermott Will & Emery is uniquely positioned to assist health industry organizations to understand and address the implications of the new law, as well as act on the opportunities it provides. Our Health Industry Advisory Practice Group is interdisciplinary, bringing together all of the regulatory, transactional, finance, restructuring and tax knowledge necessary to deliver effective, efficient and focused services to our health insurers and other third-party payors, health industry providers, and investors. We also work closely with our Employee Benefits group to provide guidance regarding this aspect of the new law.
We are currently assisting clients in implementing strategic responses to the new law designed to enhance their competitive positions. Our projects include counseling and assisting payors in the development of reform implementation plans to address both immediate and long-term changes; reviewing and redrafting employee benefits plans in compliance with the Affordable Care Act; assisting in the analysis, design and implementation of accountable care organizations; and advising clients on the structure of new and evolving provider relationships.

In June 2009, we launched our Health Care Law Reform Blog to provide timely updates on, and interpretations of U.S. health care law developments. McDermott's seasoned team of health care lawyers and government strategy professionals frequently post practical insights and analyses on how these changes will affect all elements of the health care industry, as well as suggestions on how interested parties might respond. In April 2010, the Firm held a webcast tailored to five specific industry sectors. The five-hour webcast provided insight into how the new law affects organizations in the payors, employee benefits, life sciences, health services, and private equity sectors. Our top industry specialists focused on the most pressing and profound changes to assist these industry leaders in adjusting their strategic direction and making decisions accordingly.
