Compliance Counseling
Representative environmental compliance projects include:
- Identification of modifications to manufacturing processes at facilities located in several states to avoid hazardous waste violations and reconfiguration of related 50-state service business to address noncompliance issues, as well as identification of regulatory amendments for discussion with federal agency
- Numerous representations of clients in connection with alleged civil or criminal violations of federal, state and/or local environmental laws, including alleged violations of federal RCRA, Clean Water Act, Clean Air Act, Underground Storage, TSCA, and similar or unique state environmental laws such as California's Proposition 65
- Identification of regulatory exclusion to TSCA premanufacture notification requirement and confirmation from agency officials to avoid exposure to multi-million dollar penalty
- Successful representation of pesticide registrant in state proceedings to void registration of most profitable herbicide
- Representation of both individual clients and PRP groups across the United States in Superfund negotiations and settlements, including both cleanups and cashouts
- Service as experts on environmental compliance issues in federal and state proceedings
- Negotiation of first exemption to TSCA premanufacture notification requirements (the instant film exemption)
- Representation of clients in air, water, and hazardous waste permitting, closure and compliance issues for major facilities
- Advice and counsel in preparation and establishment of computerized system to identify U.S. and overseas environmental requirements and instances of noncompliance for worldwide facilities operated by multinational company
