Elections & Political Law

Based in Washington, D.C., our Elections and Political Law Group advises clients on political, legislative and election-related issues. We have represented presidential and senate campaigns and counseled Fortune 500 companies. Our practice encompasses advising on Federal Election Campaign Act compliance, government ethics and public policy issues, in addition to working with federal and state election, campaign finance and voting rights laws.

Our lawyers have significant political litigation experience, including novel and complex issues, at the federal district, appellate and U.S. Supreme Court levels. One of our lawyers successfully argued an election law case before the U.S. Supreme Court, winning a 9-0 decision for his clients in the case of Foster v. Love, 522 U.S. 67 (1997). Another group member is the author of "Judicial Deference to the Federal Election Commission," 66 Geo. Wash. L. Rev. 917 (1998). We are recognized as leaders in this area, and have appeared as commentators in numerous television and radio venues, including appearances on CNN and the Fox News Channel during the ballot controversy of the 2001 presidential elections.

Our Elections and Political Law Group is part of our Firm's highly respected Government Strategies Practice Group which includes a significant number of professionals with prior experience as senior decision-makers in the executive and legislative branches of the federal government. We maintain close ties to the leadership and key decision-makers in Congress, the White House and federal agencies and departments. In Congress, we work on issues with virtually every committee—from tax, trade and health matters before the House Committee on Ways and Means and the Senate Committee on Finance, to issues before congressional panels on agriculture, banking, commerce, energy, the environment, the judiciary and labor. We also are active in the appropriations process as it affects clients.

We represent many of the United States' leading corporations and trade associations. Our services range from intensive lobbying and issue monitoring to targeted assistance in a discrete area. Our practice also includes experience in tax issues regarding political action committees in their various forms, including handling tax inquiries from political action committees and tax-exempt organizations that have made political expenditures. Our lawyers have reorganized several section 501(c)(3) charitable organizations to include section 501(c)(6) trade associations for the purpose of allowing membership organizations to create and sponsor a PAC. Additionally, our lawyers have set up independent connected committees for various tax-exempt organizations in the past.
