Program Summary
On October 30, 2008, the U.S. Court of Appeals for the Federal Circuit issued the much-anticipated In re Bilski decision. In the en banc decision, the Federal Circuit re-established the Supreme Court of the United States’ earlier “machine-or-transformation test” for determining the patentability of a process. Under this test, a process must be either tied to a particular machine or apparatus, or transform a particular article into a different state or thing.
Together with other relatively recent decisions, such as In re Nuijten and In re Comiskey, the Bilski decision continues a trend of narrowing the scope of patentable subject matter. This trend must be understood and accounted for when developing patent strategies designed to protect software and business method inventions. This trend also must be understood in order to effectively anticipate and respond to patent prosecution issues before the U.S. Patent and Trademark Office.
Mark Itri and Andrew Mickelsen, intellectual property lawyers in McDermott’s Orange County office, will present an overview of recent court decisions that have addressed the scope of patentable subject matter and lead a discussion on the impact of these decisions on the patentability of software and business method inventions.
