Wayfair asked the Supreme Court to reject hearing the case that involves remote seller taxation, saying the issue falls squarely upon Congress to settle. “Congress, having the clear constitutional authority and responsibility in the area of regulating interstate commerce, is the branch that is not only best suited but appropriate to address the issue,” Mr. Rosen concluded.
