Mark Pearlstein, Laura McLane, Evan Panich and M. Miller Baker were co-counsel in Universal Health Services Inc. v. U.S. and Massachusetts ex rel. Escobar et al., described as “the biggest government contracts-related court decision in many years.” In it the US Supreme Court defined the “materiality” standard for the “implied certification” theory of FCA liability, a holding that continues to be debated in the lower courts.
