FTC’s Ill. Hospital Merger Suit Gets 3rd Circ. Boost

Jeffrey Brennan said the Third Circuit’s approval (in a case involving two Pennsylvania hospitals) of the FTC’s method of determining the relevant geographic market for hospital mergers is an important endorsement. “For practitioners who have appeared before the FTC, the method of analysis that the court described is not new,” Mr. Brennan noted. “But here, we have an appellate decision that basically agrees with the FTC.”
