McDermott’s pro bono lawsuit against the Justice Department for the Mattachine Society of Washington, DC, claiming that DoJ violated the Freedom of Information Act by refusing to release documents linked to a 1950’s federal government anti-gay executive order, was discussed. DoJ denied acting improperly, but McDermott’s lawsuit holds that the requested documents “do not fall within any of FOIA’s exemptions from required disclosure, including but not limited to those exemptions cited by” the Department.
