Overview
Tony Maida said that a current challenge by a major insurer to Medicare Advantage overpayment provisions could help others decide to challenge the Medicare Parts A and B overpayment rule recently released by CMS. Mr. Maida noted that most providers have well-developed compliance programs that position them to meet the rule, but added that this is the first time CMS has really addressed compliance programs in rulemaking.
