Prosecutors Often Balk at Capital Cases

Mark Pearlstein, speaking on the effort by federal prosecutors to seek the death penalty for the accused Boston Marathon bomber, expressed the belief that many such prosecutors “are opposed to the death penalty and would not be interested in working on such a case, including a lot of capable and experienced people.” Mr. Pearlstein recalled declining a death penalty case which arose when he was first assistant US attorney in Boston and in which he told his colleagues, “I’m against the death penalty.
