Todd Welty represented a German billionaire in a Second Circuit appeal of a lower court order that the executive must turn over to the IRS tax analyses related to his acquisition of an automotive and industrial parts supplier. To one of the circuit court judges who asked whether a remand was possible to have the lower court judge review thousands of other documents at issue, Mr. Welty said, “We agree that a remand is possible, though not necessary.”
