Chris Scheithauer assessed how a 2013 California law has made it easier for employees to show to show wage-and-hour injury from pay stub violations. “Before the statute was amended, technical violations on wage statements were more of a throwaway claim — they had no real teeth,” Mr. Scheithauer said. “But now that the law presumes damages, plaintiffs attorneys are testing that. Plaintiffs attorneys believe that they now do not have to show the employee was actually harmed because the statute builds it in.”
