Ankur Goel said that, given the political nature of the House Republican lawsuit over Affordable Care Act implementation, one could make the case that “the ability to sue ought to be decided up front, before going through the actual substance of the litigation.” The Obama Administration has said it will ask a federal appeals court to make such a decision before the lawsuit proceeds.
