Questions Linger As Family Dollar Antitrust Review Wears On

Jon Dubrow assessed the FTC review for the proposed merger of two discount retailers seeking to thwart a competitor’s hostile buyout, saying that the retailers’ estimate for store divestitures “doesn’t seem like a made-up number” and it “allows them to make some assumptions about what would happen in the hostile deal.” Warren Rosborough noted that the hostile competitor’s argument that its bid would enhance competition against Wal-Mart contended that “as big as these dollar stores are, they’re battling against a big behemoth,” adding that “the Wal-Mart angle [can] help mitigate whatever concern the agency might have about consolidation in each of the local markets.”
