High Court Ruling to Spur Push for Broader Patent Damages

Paul Schoenhard commented on the Supreme Court of the United States’ decision in WesternGeco LLC v. Ion Geophysical Corp. that patent owners can recover profits lost outside the United States because of infringement. “Even beyond the issue of lost profits, today’s decision could suggest that courts should consider damages on a case-by-case basis without some of the strict requirements for damages that have been imposed over the last decade,” he said.
