M. Miller Baker said that if the Matt Sissel v. Department of Health and Human Services Supreme Court case (which challenges the constitutionality of how the Affordable Care Act was passed) “were to succeed, it would be devastating” to the Act. Mr. Miller added, however, that it has little chance of success because, unlike the lawsuit’s allegation, the ACA did technically originate in the House as constitutionally required.
