With the enactment of US tax reform legislation last year, the first half of 2018 has easily been one of the busiest and most challenging periods on record for many in-house tax professionals—both domestically and abroad. Over the past six months, the US Department of the Treasury and Internal Revenue Service have issued guidance in a number of areas that will directly impact many US and foreign companies’ 2017 income tax returns. With so much change and uncertainty afoot, and so little time, it is critical for in-house tax professionals to understand which changes might affect their 2017 tax positions, and what guidance is available to help them navigate those changes. - the repeal of section 958(b)(4);
- the application and interstices of section 965;
- earnings and profits determinations, and information reporting under section 6038;
- elections under section 965(n) not to apply the net operating loss deduction; and
- related state and local tax considerations.
