DOL Proposes FMLA Expansion for Same-Sex Marriage Employees


Todd Solomon said that employee benefit coverage for same-sex married partners “used to be … for benefit plan sponsors … in large part a matter of choice but now, with a few limited exceptions, much of this is mandated. Retirement plans are mandated, FMLA is mandated.” As a result, Mr. Solomon continued, “It’s not even that the tide is turning anymore” for providing same-sex married couple coverage; it in fact “has turned, at least from a benefits standpoint.
