Bethany (Beth) K. Hatef advises clients on a wide variety of regulatory and distribution issues in the alcohol beverage industry.

As a member of the Firm’s Chambers-ranked Alcohol Regulatory & Distribution Group, Beth regularly counsels alcohol industry clients on federal and state requirements relating to the production, marketing, distribution and sale of beer, wine and spirits. She assists clients in negotiating and entering into distribution relationships and provides counsel on the impact of state franchise requirements on supplier-distributor contracts and relations. Beth frequently evaluates and advises clients on the legality of promotional programs and related activities under federal and state trade practice laws and regulations, including tied house restrictions. She often navigates state restrictions on direct-to-consumer deliveries of alcohol beverages.

  • Advised a craft brewer in connection with a sale of a minority stake and substantial minority investments in other craft brewers, including conducting due diligence, negotiating and executing contractual documents, and analyzing alcohol beverage license transfer requirements and successorship issues relating to the brewers’ distribution networks
  • Counseled suppliers on various issues relating to consolidation and termination of distribution relationships
  • Advised brewers and beer importers on the legality under state alcohol laws of sponsoring special events in various markets
