CHICAGO (August 31, 2005) — Today, McDermott Will & Emery filed suit in the Southern District of Illinois on behalf of a graduate student, Ms. Blue Macellari, against the owners of three websites for the alleged unauthorized use of the student's manuscript, and resulting damages. McDermott is representing Ms. Macellari on a pro bono basis. The complaint alleges that Ms. Macellari learned of the unauthorized use of her manuscript after being notified that simple searches on her name using internet search engines returned links to three websites, doingmyhomework.com, freeforessays.com and freefortermpapers.com, websites registered to defendants Rusty Carroll and/or R2C2, Inc.
The complaint alleges that the unauthorized use and posting of the manuscript by Rusty Carroll and/or R2C2, Inc. through these websites violates the U.S. Copyright and Lanham Acts. In addition, the complaint charges violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, reputation-damaging defamation, unwanted invasion of Ms. Macellari's privacy, and that Ms. Macellari has been placed in a false light, wrongly suggesting, among other things, that she submitted her manuscript to these websites or was a customer of these websites. Finally, the complaint asserts similar violations and claims against internet service provider, Digitalsmiths.
