WASHINGTON, DC (July 13, 2010) — McDermott Will & Emery announced today that former Federal Trade Commission (FTC) official Jeffrey W. Brennan has joined the Firm in Washington as a partner in its Antitrust & Competition Practice Group.
From 2001 to 2005, Mr. Brennan headed the FTC's Health Care Services and Products Division, where he was responsible for managing antitrust investigations, litigation, and policy initiatives focused on health care competition -- with particular focus on the hospital, medical professionals and pharmaceutical sectors. During his tenure, he had direct oversight responsibility for FTC health care enforcement initiatives across the entire antitrust spectrum, including health care mergers and joint ventures, provider pricing conduct and pharmaceutical patent settlements involving so-called "reverse payments." In 2005, Mr. Brennan was promoted to Associate Director of the FTC's Bureau of Competition, where he oversaw and directed the FTC's merger and non-merger investigations and enforcement initiatives across various industries (including health care matters) and he was tasked with a variety of special projects involving health care competition issues. Upon departing the FTC in late 2006 to return to private practice, he received the FTC's Award for Distinguished Service in advancing the Agency's competition mission -- with special recognition for his achievements in the health care sector and merger analysis. Mr. Brennan joins McDermott from the Washington office of Dechert LLP.
"We are delighted to welcome Jeff to McDermott," said Joseph Winterscheid, partner and head of McDermott's global Antitrust & Competition Practice Group in Washington. "Jeff has extensive experience in virtually all antitrust disciplines across a broad range of industries, including health care, manufacturing and retailing, and his arrival substantially enhances our overall antitrust practice. McDermott has long been recognized as having one of the leading antitrust health care practices in the country, and adding Jeff to our team gives us truly exceptional capability and depth in this critical field."
“Health care reform initiatives have fueled an intensified drive toward hospital-physician integration and hospital merger activity, and the entire industry is coming under ever-increasing scrutiny by the federal and state antitrust enforcement agencies,” added Stephen W. Bernstein, partner and head of McDermott’s global Health Practice Group. “Jeff's extraordinary expertise in health antitrust matters from his vantage point as both a former regulator and many years in private practice will make him an invaluable resource to our health industry clients.”
Commenting on his move to McDermott, Brennan stated: "I am truly excited to be joining McDermott. Not only does it have a highly-regarded antitrust practice, but McDermott is also generally acknowledged to have one of the premier health industry practices in the United States. I look forward to working with the Firm's outstanding clients and lawyers in addressing the challenges confronting the health care industry and other sectors in the current antitrust enforcement climate.”
