DOMA Repeal Won't End Financial Uncertainty for Gay Couples

Todd Solomon said that, even if the US Supreme Court invalidates the Defense of Marriage Act (DOMA), employers could still exclude gay couples from their benefit plans. “DOMA is a crutch for denying benefits, but the other part is employers actually providing coverage," Solomon said. "I think some employers will absolutely say, ‘Our plan only covers opposite-sex spouses.’” He cited a Pennsylvania federal court case where such a denial to a legally married same-sex couple was the issue.
