Mr. Maida, who until last month was the Deputy Chief of the Administrative and Civil Remedies Branch (ACRB) of the Office of Counsel to the Inspector General (OIG) at the United States Department of Health and Human Services (HHS), is based in McDermott’s New York office.
At OIG, Mr. Maida was the principal author of the OIG’s current Self-Disclosure Protocol and of the Notice of Proposed Rulemaking for the OIG’s civil monetary penalty (CMP) authorities. He was involved in OIG decision-making as to which federal Anti-Kickback, Stark, False Claims Act and CMP cases were meritorious and should be pursued.
Mr. Maida began his tenure at OIG in 2005. From 2007 to 2014, he served as the Deputy Chief, leading a team of a dozen HHS-OIG attorneys on False Claims Act and CMP cases, including conducting investigations and negotiating settlements and Corporate Integrity Agreements. In addition, Mr. Maida was detailed in 2013 to the Centers for Medicare and Medicaid Services where he advised on policy issues, including the Physician Sunshine Rule, the 60-day Over-payment Rule, and provider moratoria and payment suspension authorities.

Mr. Maida received many distinctions at OIG, including the Bronze Medal for Outstanding Employee of the year in 2010 and Exceptional Achievement Awards in 2013 and 2007. He graduated, cum laude, from the Boston University School of Law in 2001, after which he practiced at Choate, Hall & Stewart and then with Daniels & Porco. Mr. Maida graduated Fordham University in 1998, magna cum laude. He is admitted to the New York and Massachusetts bars.
