Brian A. Benko advises clients on employee benefits matters related to executive compensation, qualified retirement, health and welfare plans. He has experience with the design, restructuring, amendment and administration of defined benefit pension, cash balance, 401(k), employee stock ownership plans (ESOPs), governmental, nonqualified deferred compensation, employee stock purchase plans (ESPPs), and cafeteria and welfare plans, as well as incentive compensation programs. Brian has represented clients before the Internal Revenue Service, the US Department of Labor and the Pension Benefit Guaranty Corporation.
Previously, Brian worked in the Office of Tax Policy, US Treasury Department, where he assisted the attorneys and actuaries in the Benefits Tax Counsel's office with developing qualified retirement plan and executive compensation regulations. Brian also has authored articles for numerous professional publications.
An advocate for the physically and mentally disabled, Brian is very active in providing pro bono legal services. Among other awards, he was the recipient of the 2012 McDermott Will & Emery award for Outstanding Achievement and Commitment to Pro Bono and Service to the Community. Brian is a member of the Firm's Pro Bono and Community Service Committee for the Washington, DC, office.
