Mark A. Collins is co-head of the Firm’s Insurance Litigation & Counseling Team. He counsels clients on a wide array of insurance law issues, with a focus on D&O, E&O, EPL, cyber, crime/fidelity, property and transactional insurance products such as representations and warranties, and tax liability insurance.
Mark works with clients and their brokers to negotiate policy terms and conditions when placing or renewing insurance. Mark also assists insurance companies in drafting and updating specimen policy forms and endorsements. Mark frequently advises on the insurance and risk management aspects of mergers and acquisitions. He conducts insurance due diligence, assists with the negotiation and placement of “tail” coverage, and represents buyers and sellers during the underwriting of their representations and warranties insurance to ensure they receive the policy wordings most favorable to their interests.
Mark has extensive experience analyzing coverage and preparing coverage opinions on claims under many different lines of coverage. He assists clients in submitting insurance claims, coordinating the defense of (or defense cost reimbursement for) underlying claims, and responding to insurers’ requests for information.
Mark also maintains an active litigation and arbitration practice. When helping clients protect their interests and attain their business goals through insurance analysis, placement and claims, Mark often draws on lessons learned during his many years of representing members of the insurance industry in some of the most significant insurance coverage disputes of the past three decades. His experience includes the litigation of environmental and asbestos matters, 9/11-related intra-insurer contribution disputes and settlements, and insurance and reinsurance claims involving alleged child sexual abuse in the church, school and youth organization settings.
